Funshoot Terms and Conditions
Our terms and conditions are part of the professional service that we provide to our customers. We expect your event will run smoothly but we have to plan for the highly unlikely and the unexpected and let you know what will then happen. Our promise is to provide you with the best service possible.
This current version overrides any terms sent to customers prior to 1st July 2018.
The Provider or “we” “us” “our” – Funshoot Photobooths
The Customer or “guests” or “you”– The person, company or organisation who booked Funshoot Photobooths to provide services for their event.
“Equipment” consists of any item of hire, including props. All equipment remains, at all times, the property of Funshoot Photobooths
1. Booking Fee and Payments
When a booking is made with Funshoot Photobooths regardless of the method of contact it is deemed that the customer has read, understood and is bound by our terms and conditions of hire.
A £40 booking fee is required to secure a booking. This must be paid within 7 days of making the booking. Payment can be made via our online booking system. Please let us know if you prefer an alternative method of payment and we will be happy to assist. Bookings are not deemed final until this fee is received by the provider. If the booking fee is not received in this time then the date may be released to other customers. Booking fees are non-refundable, except at the discretion of the provider.
All full balances need to be received and cleared 28 days prior to the event.
2. Cancellation and Date Changes
Cancellation up to 42 days prior to the event – full amount of monies paid will be refunded excluding the booking fee.
Cancellation between 41 days and 29 days before the event – a refund of 50% of the monies paid will be refunded excluding the booking fee
Cancellation within 28 days of the event - no refund of any monies will be paid (subject to Provider’s discretion)
Any request for a date change must be made in writing at least 42 days in advance of the original event date. Change is subject to availability. If there is no availability for the date requested the event booking will be cancelled and the booking fee forfeited. Requests for date changes after 42 days prior to the original event date will be subject to the above cancellation fees should there be no availability on that requested date.
Cancellation charges must be paid within 21 working days of our invoice.
3. Use of images and data
Your images will be added to our facebook page @funshootphotobooths and to your online gallery via our website www.funshoot.co.uk. You will be sent a link to your online gallery the morning after your event. You and your guests will be able to download, like and share these images. Please make us aware if you do not want images to be added to our facebook or website. We cannot be responsible for how you or your guests share these images. Images may also be selected for advertising and promotional materials.
We have the facility for guests to upload images directly to their email address to then share on social media but this is subject to Wi-Fi availability at your chosen venue. If this facility is requested Funshoot Photobooths accept no liability for how these photographs will then be used.
We keep photos on our systems for 2 months after your event, after this period the photos are deleted.
Your contact details, name, address, email address and telephone number will be kept on our system and we may use this to contact you in future with details of promotions and services. Please notify us if you do not wish this to happen.
We do not share your details with any other organisation unless in relation to your booking.
Funshoot.co.uk will appear on all photographs
4. Location of event and booth
The customer is responsible for ensuring Funshoot Photobooths is given the correct date, time, venue address, postcode and contact details. We cannot be held responsible for delays due to incorrect information. This information must be provided on the booking form.
We cover a radius of up to 50 miles of our base postcode SR7 9RX after that there will be a charge of 50p per mile
The photo booth has the following dimensions – length 2.5m x width 1.5m x height 2m. If the VIP entrance is included, please allow an extra 4ft to the width. It is the customers responsibility to ensure there is sufficient space at their chosen venue for the booth. Funshoot will provide the prop and guest book tables.
The photo booth will be located upon agreement with the venue, customer and provider unless the provider identifies this will cause issues with health and safety. Once set up the booth cannot be moved to another location.
Items for hire are for indoor use only or in a totally waterproof marquee with a solid floor. Between 1st of October and the 1st of May marquees must be heated as this can affect the operation of the equipment.
If the above conditions are not met the service will not be provided and the hire fee is still payable.
5. Timings, setting up and taking down the booth.
Should you need to change timings for your booth hire we will do our best to accommodate them but cannot guarantee we can meet these changes.
We will arrive approximately 90 minutes prior to the hire start time to allow set up and testing of the booth. We will contact the venue to arrange access. In the unlikely event that the venue refuses to allow early access to enable set up of the booth we will inform you. If this cannot be resolved by you then set up time will then be included in the hire time.
There must be suitable parking facilities in your chosen venue for the duration of the booking and reasonable access for both loading and unloading of equipment.
At the end of the hire time we will dismantle the booth and remove it from the venue
Set up and dismantling will be done with minimum disruption, but the customer must be aware that we cannot be held liable for any disruption caused. We offer “idle time” for a small additional charge to avoid any potential disruption. Quotes are available on request. Idle time must be booked a minimum of 14 days in advance and may not be available.
5.Delivery of LED lights
LED letters will be delivered early morning and collected on the evening once your event has ended. We contact your venue event organiser to arrange the most suitable times based on your event.
6. Power supply
Items for hire require access to mains supply electricity within 10 metres. If using a generator, please advise us in advance to ensure it is suitable. Funshoot Photobooths cannot be held responsible if the event venue electric supply is faulty and effects the running of the hired items. If it is shown that the venue is at fault no refund is due, if the fault is with Funshoot Photobooths then a refund will be payable as detailed in section 9
We carry £10m Public Liability Insurance, no single claim can exceed this amount. Certificate copies are available on request.
Our electrical equipment is annually PAT tested. Certificates copies are available on request.
8. Damage to equipment and safety of staff
If it is deemed that the behaviour of guests could affect the safe running of our equipment, damage to the photo booth, props or other equipment and/or threats are made to our staff we reserve the right to immediately cease use of the equipment and remove it from the event. We will always try to speak to the host first to try to resolve the matter before terminating. In this instance the hire fee remains payable in full.
The customer is responsible for any damage to the hired items by their guests.
If the attendant feels due to excess alcohol consumption someone is unfit to use the photo booth we reserve the right to refuse them access to the booth.
Attendants are trained to help prevent the above from happening and whilst this is a very rare occurrence the safety of guests and themselves must take priority.
9. Events beyond our control
While it is our intention to attend any event that you have booked our services for, there may be circumstances that make this impossible due to, but not limited to, adverse weather conditions. We reserve the right to cancel any booking due to adverse weather conditions and provide a full refund. Should circumstances beyond our control such as traffic accidents and delays result in us not being able to arrive to the event for the agreed time we will extend the hire so that the hire period is the same as the booking. If this is not possible we will refund you accordingly for the time delay in proportion to the amount paid.
10 Hire Period Downtime
While we intend to have the booth fully operational during the hire period it may be necessary to have downtime for booth maintenance. This can include changing/ replacing paper/ink, rebooting the computer system, replacing damaged cables etc. Downtime is rare, and we will carry out this maintenance as quickly as possible. Electrical equipment can break down with no warning and whilst this is extremely rare we will do all we can to continue the running of the booth. In the unlikely circumstance that we cannot continue with the hire due to technical failure we agree to provide a full refund to the customer on a pro-rata basis
80% or more operational – nil refund
79 – 60% operational – 25% refund
59 – 40% operational – 50% refund
39 -20% operational - 75% refund
19% or less operational – full refund
Downtime will be calculated by either or all: reports from staff, exit data images, print logs and computer records. All claims shall not exceed the amount shown above
In the event of partial failure, e.g. printer failure, we will provide a full set of reprinted photos free of charge after the event. We will endeavour to work around a partial failure to continue operation of the booth for the hire duration. In the unlikely event of this happening refunds will be at our discretion and as a gesture of goodwill only.
11 Additional Services
The provider offers additional services to compliment the photo booth for example guest book, dressed prop and guest book tables, greenscreen, direct social media uploads, stanchions and red carpet.
While every care is taken by the provider we accept no liability in case of damage or loss caused by the customers guests whether accidental or malicious
Guest book- the provider will encourage guests to leave a message and place a photograph in the guest book and this will be handed to the customer at the end of the event. We cannot however guarantee that guests will do this.
Greenscreen – if the customer wishes to use their own images for the greenscreen backgrounds we accept no liability for copyright infringements and will assume that the customer has permission to use any images provided. Please contact us for pixel sizes etc
We aim to provide high quality images but there are some factors such as movement whilst the photograph is being taken, lighting from the venue, colour of clothes worn (green will not be seen against the greenscreen for example) that prevent us from guaranteeing that all photos will be of this quality
12. Health and Consent
Guests must consider if use of the booth could affect their health for example use of a flash and epilepsy. Children and guests who are not able to give their consent must be accompanied by an appropriate adult/carer and in doing so they will be responsible/considered as having obtained the necessary consent. If in doubt our advice is to refrain from taking part. The adult does not have to appear on the photograph. Funshoot Photobooths accepts no responsibility if clients do not adhere to these rules.
The customer will indemnify the provider against all liability related to the customers event during or after the customers event. Customer will indemnify provider from the time of service and on into the future against any liability associated with the customer.
The customer will indemnify the provider against loss or damage to property owned by those using the photo booth or items for hire or personal injury or death of any participants however caused, unless proven negligence of Funshoot Photobooths
